Welcome to SleepHaven. You have entered the website owned and operated by SleepHaven, identified by the URL www.sleephaven.my (the “Site”). Before proceeding further, please read carefully the following Terms and Conditions of Use, which govern your access and use of the Site (“Terms and Conditions,” including any modifications that may be made from time to time by SleepHaven).

By using the Site or placing an order through the Site, you agree to and accept all these Terms and Conditions, thereby entering into a binding agreement with SleepHaven regarding your use of the Site.
In addition, when you use any current or future SleepHaven service(s), you will also be subject to the guidelines, policies, and conditions applicable to such services or businesses.

Use Of Site Access

SleepHaven grants you a limited, non-exclusive license to access and make personal, non-commercial home use of this Site. You may not download the Site (other than page caching), modify the Site or its contents, or alter any portion of the Site without the prior written consent of SleepHaven.


This license does not permit:
•  Any resale or commercial use of this Site or its contents.
•  Any collection and use of product listings, descriptions, or prices.
•  Any derivative use of this Site or its contents.
•  Any downloading or copying of account information for the benefit of another merchant and/or user.
•  Any use of data mining, robots, or similar data-gathering and extraction tools.

This Site, or any portion of it, may NOT be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without the prior express written consent of SleepHaven.


You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of SleepHaven and the Site without SleepHaven’s prior express written consent. You may not use meta tags or any other “hidden text” utilising SleepHaven’s name, trademarks, or the Site without prior written consent from SleepHaven.


Any unauthorised use automatically terminates the permission or license granted by SleepHaven.
You are granted a limited, revocable, and non-exclusive right to create a hyperlink to the homepage of the Site so long as the link does not portray SleepHaven, the Site, or its products and services in a false, misleading, derogatory, obscene, or otherwise offensive light. You may not use any SleepHaven logo, Site logo, or other proprietary graphic or trademark as part of the link without SleepHaven’s prior express written consent.

Your Particulars

When you register with SleepHaven, you agree to:
1.  provide true, accurate, current, and complete information about yourself as prompted by the order form (the “Order Data”); and
2.  maintain and promptly update the Order Data to keep it true, accurate, current, and complete.

You are solely responsible for maintaining the confidentiality of your Order Data and passwords, as well as for restricting access to your computer or device. You agree to accept full responsibility for all activities that occur under your account or particulars.
SleepHaven shall not be liable for any loss or damage arising from your failure to comply with these Terms and Conditions.
If you are under 18 years of age, you may use this Site only under the supervision and involvement of a parent or legal guardian.
SleepHaven reserves the right, at its sole discretion, to refuse service, remove or edit content, or cancel orders without prior notice.

Order Acceptance & Cancellation

Placing a product in your cart does not guarantee availability. Orders are confirmed only upon successful payment and order acknowledgement from SleepHaven. SleepHaven reserves the right to cancel or refuse any order due to stock unavailability, payment failure, suspected fraud, or errors in pricing or product information. If payment has been made, you will receive a full refund for cancelled orders.

Pricing & Payment

All prices listed are in Ringgit Malaysia (RM). Prices may include or exclude SST where applicable. We accept payments via credit or debit cards, FPX online banking, TouchN’Go e-wallet, or an instalment payment option via Atome. Deliveries to East Malaysia may require a third-party courier service and are subject to availability. Customers must ensure that the delivery address provided is accurate and that someone is available to receive the item.

Risk of Loss

SleepHaven provides free delivery for all mattress purchases. Ownership of the product passes to you upon successful delivery to your address. However, if your mattress arrives damaged, defective, or incorrect, you may request a replacement or refund by contacting our support team within the stated period in our Return Policy.


Customers who wish to arrange for old mattress disposal must inform our support team in advance so that the service can be scheduled together with the delivery.


If you are not satisfied with your purchase, you are also covered by our 30-day trial period, during which you may request a return and refund in line with our Return Policy.

Termination

SleepHaven reserves the right, at its sole discretion, to suspend or terminate your access to this Site at any time if you are found to have violated these Terms and Conditions, misused the Site, or engaged in any activity that disrupts or compromises our services.
SleepHaven may also, at its discretion, discontinue or restrict the availability of certain features, services, or the Site itself, with or without prior notice.


In such cases, SleepHaven shall not be held liable to you or any third party for any termination of access or discontinuation of services.

Indemnity

By using this Site, you agree to indemnify and hold harmless SleepHaven, its affiliates, directors, officers, employees, and agents from any claims, losses, damages, liabilities, costs, or expenses (including reasonable legal fees) that arise from:

•  your misuse of the Site,
•  your breach of these Terms and Conditions, or
•  your violation of any rights of another party.

SleepHaven reserves the right, at its own expense, to take over the exclusive defence and control of any matter otherwise subject to indemnification by you. In such cases, you agree to cooperate fully with SleepHaven in the defence of such claims.

Disclaimer of Warranties and Limitation of Liability

This Site and its content are provided by SleepHaven on an “as is” and “as available” basis. While every effort is made to ensure accuracy and reliability, SleepHaven makes no warranties or representations, express or implied, regarding the operation of the Site, the information provided, or the products offered. By using this Site, you agree that you do so at your own risk.


To the fullest extent permitted by law, SleepHaven disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.


SleepHaven does not guarantee that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.


SleepHaven shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use of this Site or the products purchased through it. This includes, without limitation, damages for loss of profits, data, goodwill, or business opportunities.


Any material downloaded or otherwise obtained through the Site is done at your own discretion and risk. SleepHaven shall not be held responsible for damages to your computer system, loss of data, or other issues resulting from such downloads.


SleepHaven will not be liable for delays, failures, or disruptions caused by circumstances beyond our reasonable control, including but not limited to internet outages, power failures, natural disasters, strikes, or government actions.

Applicable Law

This Site is created, owned, and operated by SleepHaven. These Terms and Conditions are governed by and shall be interpreted in accordance with the laws of Malaysia, without regard to conflict of law principles.


By accessing or using this Site, or by placing an order through it, you agree to comply with all applicable laws and regulations. If you access the Site from outside Malaysia, you are responsible for ensuring compliance with your local laws, to the extent they apply.


By using the Site, you irrevocably agree and consent that any disputes, claims, or matters arising out of or relating to these Terms and Conditions shall fall under the exclusive jurisdiction of the courts of Malaysia.

Accuracy of Information

SleepHaven strives to provide accurate and up-to-date details about our products on this Site. While every effort is made to ensure descriptions, specifications, and images are correct, there may be slight variations in color, materials, or design. To the extent permitted by law, SleepHaven does not guarantee that all content on the Site will be free from errors, complete, or fully current.

Modification and Discontinuance

SleepHaven reserves the right, at any time, to update, change, or discontinue any part of this Site, including these Terms and Conditions, without prior notice. Any changes will be posted on this Site and will take effect immediately upon posting. By continuing to use the Site after such changes, you are deemed to have accepted the updated terms.

If SleepHaven does not enforce any part of these Terms and Conditions at any time, it shall not be interpreted as a waiver of our rights to enforce that provision or any other provision in the future. Any waiver by SleepHaven must be in writing to be effective.

SleepHaven is the sole owner or lawful licensee of all rights to this Site and its content, including but not limited to text, images, graphics, logos, designs, photographs, product descriptions, software, audio, and video (collectively, the “Content”). All ownership and intellectual property rights in the Site and its Content shall remain with SleepHaven, its affiliates, or its licensors, as applicable. All rights not expressly granted under these Terms and Conditions are reserved.

The unauthorized copying, reproduction, modification, distribution, publication, or use of any part of this Site or its Content without prior written consent from SleepHaven is strictly prohibited.

Notices and Communications

By visiting the Site or contacting us through e-mail, you are communicating with SleepHaven electronically. You consent to receive communications from us electronically. We may communicate with you by e-mail, WhatsApp, SMS (if provided), or by posting notices on the Site.


You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically shall satisfy any legal requirement that such communications be in writing.

Severability

If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable for any reason under the laws of Malaysia, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions.

Entire Agreement

These Terms and Conditions constitute the entire agreement between you and SleepHaven regarding your use of this Site and any purchases made through it, superseding any prior agreements or understandings between you and SleepHaven (including, but not limited to, any prior versions of these Terms and Conditions). You may also be subject to additional terms and conditions when using certain SleepHaven services, promotions, or third-party features made available through the Site. Any assignment, transfer, or delegation of these Terms and Conditions or any rights granted under them is strictly prohibited without prior written consent from SleepHaven.

The headings in these Terms and Conditions are provided for convenience and reference only. They do not form part of the Terms and Conditions and shall not affect the interpretation or construction of any provision contained herein.

Returns & Refunds

SleepHaven’s products are covered by our Return & Refund Policy, which includes a 30-day trial period, and returns for defective or damaged items.
